This website is operated by Top Notch Vintage ("we", "us", "our"). These Terms of Service ("Terms") apply to all users of the site, including browsers, customers, and anyone submitting content to the site.
By visiting our site and/or purchasing from us, you agree to be bound by these Terms, including any additional policies referenced here (such as our Returns Policy and Privacy Policy). If you do not agree to these Terms, please do not use the site.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
We may update these Terms at any time by posting changes to this page. It is your responsibility to check periodically. Continued use of the site after changes are posted means you accept them.
Our store is hosted on Shopify Inc., who provide the e-commerce platform we sell through.
SECTION 1 — ELIGIBILITY AND USE OF THE SITE
You must be at least 18 years old, or using the site under the supervision of a parent or guardian who agrees to these Terms on your behalf.
You agree not to use the site or our products for any unlawful purpose, and not to transmit any virus, malware, or code of a destructive nature. Any breach of these Terms may result in immediate termination of your access to the Service.
SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse service to anyone, at any time, for any lawful reason.
Data sent to and from the site may be transmitted over open networks and is not always encrypted; however, all payment/card information is encrypted in transit.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, or scrape, crawl, or extract site content (including product photography and descriptions), without our prior written permission.
Headings in this document are for convenience only and do not affect interpretation.
SECTION 3 — VINTAGE AND PRE-OWNED ITEMS
Because our stock is vintage and/or pre-owned:
- Each item is one-of-a-kind unless stated otherwise. Once sold, an identical replacement may not be available.
- Items may show signs of wear, ageing, fading, or minor imperfections consistent with their age and history — this is expected and does not make an item faulty. Where known and visible, we describe condition honestly in the listing.
- Colours may vary slightly from photographs due to lighting, screen settings, and the natural characteristics of vintage fabric/materials.
- Measurements are provided as accurately as possible, but vintage sizing does not correspond to modern sizing — please check measurements, not just the label size, before buying.
This section does not remove your right to a refund or replacement if an item is significantly not as described, faulty beyond what was disclosed, or not of satisfactory quality given its age and price, under the Consumer Rights Act 2015.
SECTION 4 — PRICING, AVAILABILITY, AND PRODUCT INFORMATION
Prices, product descriptions, and availability are subject to change without notice. We aim to display product colours and details as accurately as possible but cannot guarantee your device's display is fully accurate.
We reserve the right to limit quantities, refuse orders (e.g. suspected reseller/bulk buying, fraud risk, or delivery to a region we don't serve), or discontinue any product at any time.
If we discover a pricing or listing error after you've ordered, we will contact you before processing payment or dispatch, and you may cancel at no cost.
SECTION 5 — YOUR RIGHT TO CANCEL (UK DISTANCE SELLING RIGHTS)
If you are a consumer buying from us in the UK, you generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason, under the Consumer Contracts Regulations 2013. To cancel, contact us at sales@topnotchvintage.co.uk.
Full details of how this works alongside our own returns policy — including time-frames, condition requirements, and who pays return postage — are set out in our Returns Policy, which forms part of these Terms.
This statutory right does not apply to items excluded by law (for example, items made or personalised to your specification, or sealed goods unsuitable for return once unsealed for hygiene reasons, if applicable to any of our products).
SECTION 6 — ORDERS AND BILLING
You agree to provide accurate, current billing and contact information and to keep it updated. We may cancel or limit orders that we reasonably suspect involve fraud, resale, or multiple accounts used to circumvent quantity limits.
If we cancel or change an order, we will attempt to notify you using the contact details provided at checkout.
SECTION 7 — THIRD-PARTY TOOLS AND LINKS
We may link to or provide access to third-party tools or websites that we do not control. These are provided "as is," without endorsement, and your use of them is at your own risk and subject to that third party's own terms.
We are not responsible for the content, accuracy, or practices of third-party sites.
SECTION 8 — CUSTOMER COMMENTS, REVIEWS AND SUBMISSIONS
If you submit reviews, comments, or other content to us, you grant us the right to use, edit, publish, and display that content in connection with our business, without payment. We may remove any submission we reasonably consider unlawful, offensive, or in breach of these Terms.
You must not submit anything that is defamatory, infringes another person's rights, or is false or misleading. You are responsible for your own submissions.
SECTION 9 — INTELLECTUAL PROPERTY
All site content — including product photography, written descriptions, logos, and design — is owned by us or licensed to us and is protected by copyright and other IP laws. You may not copy, reproduce, or reuse this content commercially without our written permission.

Your personal data is handled in accordance with our Privacy Policy and UK GDPR / the Data Protection Act 2018.
SECTION 11 — ERRORS AND CORRECTIONS
The site may occasionally contain typographical errors or inaccuracies relating to pricing, descriptions, or availability. We reserve the right to correct these and to cancel affected orders, provided we notify you and offer a full refund where an order has already been placed.
SECTION 12 — PROHIBITED USES
You must not use the site to: act unlawfully; infringe our or others' intellectual property; harass, discriminate against, or defame anyone; submit false information; transmit malware; collect others' personal data; scrape or spider the site; or attempt to circumvent its security. Breach of this section may result in immediate termination of your access.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
Subject to that, we are not liable for indirect or consequential losses (such as loss of profit or data) arising from your use of the site, to the fullest extent permitted by law. This does not affect your statutory right to a refund, repair, or replacement under the Consumer Rights Act 2015.
The site and its content are provided "as is" without warranties beyond those implied by law.
SECTION 14 — INDEMNITY
You agree to reimburse us for reasonable losses, including legal costs, arising from your breach of these Terms or your misuse of the site, except where such losses arise from our own negligence or breach.
SECTION 15 — SEVERABILITY
If any part of these Terms is found unenforceable, that part will be severed, and the remainder will continue to apply in full.
SECTION 16 — TERMINATION

These Terms, together with our Returns Policy and Privacy Policy, form the entire agreement between you and us regarding use of the site, superseding any prior agreements or communications.
SECTION 18 — GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections in your country of residence.
SECTION 19 — COMPLAINTS AND ALTERNATIVE DISPUTE RESOLUTION
If you have a complaint, please contact us first via our Contact Form so we can try to resolve it directly.
If we're unable to resolve a dispute, you may be entitled to use an approved Alternative Dispute Resolution (ADR) provider.
